<p>21 out of 80 objectives of the Roadmap for boosting the digitisation of the economy and the development of e-commerce are already in place, following the implementation of the Digital Package 1.0 and related actions promoted by the Economic Council. A further 26 are to be achieved with the promotion of the eCommerce Package.</p>

<p>Thus, 10 topics out of 17 targeting the objective “Developing remote interaction and promoting digital services for business” are achieved, including: introduction of the “digital default” principle for public services provided to legal entities; remote registration of a company, modification of the documents for setting up or winding up a business; the possibility of using electronic signatures in employment relations between employer and employee, including the signing of remote employment contracts; unilateral recognition of qualified advanced electronic signatures issued in EU states and the possibility to interact with Moldovan authorities remotely for diaspora and European investors; possibility to obtain qualified advanced electronic signature in Moldovan consulates and remote updating of digital signature; elimination of notification and authorisation as a personal data controller, primary digital issuance of permit documents, etc.</p>



<p>According to the report, of the 39 actions on the objective “Promoting e-commerce and e-payments”, 6 are already implemented and 24 more are in advanced process of implementation, most of which are the subject of the eCommerce Package, such as: updating with EU legislation of the domestic legislation on eCommerce; consumer protection in e-commerce; tax incentives for e-commerce and non-discrimination of online payments; rethinking of local tax and notification for e-commerce; creation of a Fintech Innovation Hub, etc.</p>



<p>For the achievement of the objective “Facilitation of customs procedures for online exports, stimulation of postal and courier services” out of 14 actions 4 are achieved, such as liberalization of the postal and courier services market; establishment of customs control zones in postal operators’ offices; obtaining the status of Authorized Economic Agent for simplified customs procedures by the universal postal operator and other interested operators, etc. Another 9 targets under this strategic objective are to be achieved in the next period. In this respect the Economic Council is working on: implementation of electronic issuance of certificates of preferential origin and facilitation of cross-border e-commerce by digitizing pre-arrival processing of postal and express consignments; simplification of customs declarations, including on re-import of returns in e-commerce, and integration of the CM23 declaration into customs procedures; elimination of the customs processing fee (once customs operations are digitized); the regime for daily workers in the courier business, etc.</p>



<p>The objective “Strengthening national platforms for e-commerce, attracting international operators to the Republic of Moldova” requires rethinking actions, given the international context generated by the COVID pandemic and the war in the region, as well as adding new sub-actions.</p>



<p>In the same context, the iCouncil platform discussed the progress of the development and promotion of eKYC, eNotariat and eEntrepreneurship initiatives, existing partnerships in the Roadmap process, donor support and the identification of other constraints and solutions in the process of digitizing the economy and promoting e-commerce.</p>



<p>The Roadmap for the Digitization of the Economy was developed in a joint effort of the Ministry of Economy, the Economic Council and development partners and was approved in July 2020 and updated annually. It has become the working agenda of the Advisory Council for the Digitisation of the Economy – iConsil, chaired by the Deputy Prime Minister for Digitisation, Iurie Țurcanu.</p>

<p><strong>The study “Support for the implementation of e-Commerce infrastructure in the Republic of Moldova” was made public</strong></p>



<p>The Economic Council has made public the study and recommendations on the development of e-commerce infrastructure in the Republic of Moldova, developed with the support of the UK Government’s Good Governance Fund. According to the study, FinTech companies are not yet sufficiently present in the Moldovan market. Thus, we have an uncompetitive market, and international financial technology companies are in no hurry to come to Moldova with their financial services.</p>



<p>FinTech companies, highly developed in the world, provide financial services using software and other advanced technologies, offering a sufficiently competitive alternative to the traditional banking sector to sell services and solutions to customers. Whether it’s money transfer, lending, payment technologies or virtual currencies, FinTech companies use technologies that provide low-cost solutions that are very attractive to businesses and citizens.</p>



<p>According to experts, FinTech companies are not even interested in doing business here because the legislation governing this business segment is still imperfect. Market entry and licensing costs are very high, innovation facilitators are absent and we have a relatively low rate of use of financial tools and technologies, which does not contribute to the reduction of fees for services, proliferation of innovative payment services.</p>



<p>To redress the situation, the experts have identified the constraints and come up with a series of practical recommendations, which will be taken up by the Economic Council and promoted for approval by the authorities. These include actions to improve the institutional and regulatory infrastructure, including the creation of a unit to monitor and develop the FinTech sector. There is also a need to ensure cross-sectoral coordination between the authorities concerned, as well as the creation of a Fintech Innovation Hub to ensure entrepreneurs are well informed and new business models are encouraged.</p>



<p>At the same time, the government is urged to formulate a FinTech strategy for the development of the sector, and interested companies are encouraged to partner for a dialogue with the authorities and strengthen their efforts to increase competition, increase consumer convenience and open new business opportunities for online merchants. Experts also recommended the creation of local digital platforms – marketplaces, which would provide access to eCommerce marketplaces as well as the necessary range of new and affordable associated financial services.</p>



<p>The presentation of the preliminary results of the study took place in the framework of the Advisory Council for the Digitisation of the Economy – iConsil, chaired by the Deputy Prime Minister for Digitisation, Iurie Țurcanu, and will be included in the Roadmap for the Digitisation of the Economy and the Promotion of eCommerce.</p>

<p><strong>Discussions at the Economic Council on the concept of the Digital Transformation Strategy and the eCommerce legislative Package</strong></p>



<p>The business community, member of the Economic Council to the Prime Minister of the Republic of Moldova, debated within the Working Group of the platform “Advisory Council for the Digitization of the Economy – iConsiliu” the draft Strategy for the Digital Transformation of the Republic of Moldova for the years 2023-2030, the legislative package on stimulating eCommerce, and made proposals for updating the roadmap for the digitization of the economy.</p>

<p>Deputy Prime Minister for Digitization Iurie Țurcanu told the meeting that the Strategy sets out 6 priority strategic objectives to be achieved by the Republic of Moldova by 2030: development of a digital society; a strong, innovative and competitive ICT environment; a secure ICT and digital environment; digital public services leading to a functional digital state; international cooperation and promotion of digital Moldova; digital economy.</p>



<p>According to Iurie Țurcanu, the ICT sector has become the main driver of digitisation and innovation in Moldova and is growing rapidly. In 2020, the IT industry has reached a share of over 3% in GDP, the ICT sector’s share in GDP is over 7%, and the share of innovative enterprises is 12.6% of the total number of enterprises. However, today only 127 out of 662 public services are accessible electronically, and this hinders economic development, the deputy prime minister added.</p>



<p>Minister of Economy Sergiu Gaibu, present at the debate, spoke about the promotion of the second legislative package on stimulating eCommerce. According to Sergiu Gaibu, the document aims to revise the regulatory framework for customs procedures, postal and courier services, and online payments to facilitate e-commerce.</p>



<p>During the meeting, the authorities called on the business community to come up with proposals for improving the documents, which could be sent through the Economic Council Secretariat.</p>



<p><em>The Secretariat of the Economic Council to the Prime Minister is supported by the European Bank for Reconstruction and Development, funded by the UK Government’s Good Governance Fund, and the International Finance Corporation’s Investment Climate Reform Project funded by the Government of Sweden’s International Development Agency.</em></p>

<p>The current legislation of the Republic of Moldova needs to be supplemented in the area of private courier services and postal services in e-commerce. Today, no legislation regulates door-to-door express courier services. This is what the country’s business association sector is warning about.</p>



<p>The subject is being discussed at the Economic Council to the Prime Minister of the Republic of Moldova with the participation of representatives of the country’s courier companies and the relevant state institutions. According to the business, during the pandemic period in Moldova, fast courier services have been expanding in the so-called door-to-door regime. But the spread of this service, along with e-commerce, has revealed a number of constraints and the need for special attention to this important economic sub-sector.</p>

<p>Representatives of the business community spoke of the need to supplement legislation with provisions dedicated to the private courier industry. The amendments that will become imperative with the entry into force of the new Customs Code, starting next year, must define the notion of private courier, the authority regulating the industry and the eligibility criteria for obtaining certification to carry out private courier activity. It also discussed the need to adjust a number of departmental acts to clarify the regime for the return of goods and international reimbursement of payments made under the e-commerce regime, accompanying documents and customs and tax declarations.</p>



<p>The business community’s proposals are being discussed at the Economic Council in the context of the implementation of the Roadmap for boosting the digitisation of the national economy and the development of e-commerce. In this regard, the Economic Council with the support of the FTA/USAID Project has developed a package of legislative amendments to facilitate the development of e-commerce in Moldova, with express courier services being an important link in this process.</p>

<p class="p1"><span class="s1">Thus, through this software, economic agents from all over the country have the opportunity to keep abreast of the most important news on the regulatory framework in the economic sphere, can participate in surveys on the state of things at the moment and challenges in various sectors of the national economy.</span></p>
<p class="p1"><span class="s1">Members of the BizRadar community can come up with proposals to overcome these problems, which will immediately reach the Government&#8217;s radar, this source being a short and efficient way of interaction to contribute and improve the authorities&#8217; decisions on various topics related to the development of a favourable business environment.</span></p>
<p class="p1"><span class="s1">BizRadar also offers the possibility to give appreciation to business interaction with state institutions. Based on the estimations provided, an overall score of the institutions will be formed to measure their business performance and motivate the state authorities to continuously improve their services.</span></p>
<p class="p1"><span class="s1">Through the App, entrepreneurs can also, without revealing their identity, report abuses by state institutions.</span></p>

										<content:encoded><![CDATA[<p>30 December 2021 &#8211; By signing the document, the parties intend to join efforts in promoting business-friendly reforms on digitization of the economy and e-commerce in Moldova.</p>
<p>Among the main topics on the agenda of the Economic Council Secretariat&#8217;s is the implementation of solutions for the Roadmap topics for boosting the process of digitization of the national economy and development of e-commerce. The document was drafted by the Ministry of Economy jointly with the Secretariat of the Economic Council based on requests from the business community in Moldova.</p>
<p>The &#8220;Technologies of the Future&#8221; project, funded by USAID and Sweden, is a catalyst for modernisation and innovation in the information and communication technology, engineering, light industry, creative industries and digital media sectors in Moldova.</p>
<p>The Partnership Agreement was signed between the Director of the Future Technologies Project, Doina Nistor, and the Head of the Secretariat of the Economic Council to the Prime Minister of the Republic of Moldova, Ion Lupan.</p>
<p>Brian K Wittnebel, Deputy Director, Office of Economic Growth, USAID/Moldova, present at the signing event, noted that &#8220;on behalf of USAID, we are pleased to join efforts to support a business environment conducive to the digital economy and e-commerce, which are top priorities for the Government of the Republic of Moldova and the business community&#8221;.</p>
<p>The Director of the Future Technologies Project, Doina Nistor, said at the signing event of the Partnership Agreement that &#8220;we are confident that we can increase the digitization of the Republic of Moldova in all sectors which will create jobs, stimulate innovation and accelerate the adoption of e-commerce and the digital economy”.</p>
<p>Ion Lupan, Head of the Secretariat of the Economic Council to the Prime Minister of the Republic of Moldova, underlined during the event that &#8220;the technologies of the future, the digitization of socio-economic processes have become extremely important and topical for the Republic of Moldova, and the international expertise that the &#8220;Technologies of the Future&#8221; Project will be able to provide on the topics promoted by the Economic Council will help promote reforms in the field of digitization of the economy.&#8221;</p>
<p>Experts from the Secretariat of the Economic Council and the Moldova Future Technologies Project are already meeting in the coming weeks to discuss the dimensions of intervention.</p>

										<content:encoded><![CDATA[<h3>An interview with Ion Lupan, Head of Secretariat of the Economic Council under the Prime Minister, as part of the &#8220;Dialog Pro-Business&#8221; media campaign, supported by the Invest Moldova Agency.</h3>
<p><strong>Greetings, Ion. On 11 November, the Parliament of the Republic of Moldova voted for the first legislative package for the digitization of the Moldovan economy. In my opinion, this is a significant milestone that should be a major boost to business development. It all started with the &#8216;Roadmap for boosting the digitization of the national economy and development of e-commerce&#8217;, drawn up by the Economic Council under the Prime Minister***. So when did its development start?</strong></p>
<p>In the last two years, we have been going through a very difficult epidemiological situation, which has affected all social and economic areas in the country. Economic operators have been hit hard by the consequences of COVID-19. Movement restrictions, remote working, etc. have made us realize that we are living in a new reality. Thus, last year the Ministry of Economy, together with the Economic Council and the support of development partners &#8211; EBRD, GIZ Moldova, USAID (through the Structural Reforms Program in Moldova) and IFC &#8211; developed the &#8220;Roadmap for boosting the digitization of the national economy and development of e-commerce&#8221;. The document contains topics gathered from the business community, and they relate to the need to promote digitization processes of several processes G2B, B2B, B2C &#8211; or simply speaking &#8211; remote communication between state, citizen, and businessman.</p>
<p><strong>This is a comprehensive subject, which impacts all spheres of contemporary life&#8230;</strong></p>
<p>There are currently 80 topics in the document, compared to 37 originally included. Why do I say at this point &#8211; because the &#8220;Roadmap&#8221; is a &#8220;living&#8221; document or, put differently, Economic Council members can propose for inclusion in the document other topics that need to be addressed.</p>
<p><strong>What are the main objectives of the Roadmap?</strong></p>
<p>There are four major objectives:</p>
<p>1. Develop remote interaction and promote digital services for business;</p>
<p>2. Improving e-commerce and e-payments;</p>
<p>3. Improving customs procedures for online exports and boosting postal and courier services;</p>
<p>4. Strengthening and attracting national and international e-commerce platforms to the country.</p>
<p><strong>We won&#8217;t be able to cover all 80 topics, but we could highlight a few. Which ones are the most relevant?</strong></p>
<p>These include reforms that are long overdue and yet overlooked. For example, one brave package of proposals is about creating the conditions for an unhindered market activity for non-bank payment operators. This would allow economic agents to access cheaper, more flexible, and more modern services when making cashless payments, which at the moment are at a disadvantage, unlike the technologically advanced states and contrary to consumer and merchant expectations. We need to improve the situation in Moldova in this area.</p>
<p><strong>Can we also expect a reduction in credit card processing fees?</strong></p>
<p>This is a condition of fundamental importance. After all, the profitability of many businesses is such that every percentage of turnover is an extremely sensible value that affects the transition of a business into the online environment. Another long-awaited proposal by the business community concerns online access to the Register of Legal Entities in Moldova.</p>
<p>Today, economic agents who want to establish business relations with foreign investors have to go through a series of bureaucratic, costly, and exhausting processes to obtain from state institutions extracts from the State Register, which also has to be translated, authenticated, and apostilled. Abroad, this information is obtained through a secure portal containing open and truthful data about the company with which an investment partnership or other contractual relationship is being entered into. The same is wanted in Moldova to save time and resources.</p>
<p><strong>What are the plans for e-commerce? It has undergone major growth during the quarantine, but I suspect the momentum has slowed down again&#8230;</strong></p>
<p>To avoid any disruption, e-commerce legislation needs to be synchronized. At the moment, the E-Commerce Act and the Consumer Rights Protection Act treat certain subjects differently than the Civil Code or other more up-to-date legislation, which confuses operators in the sector.</p>
<p>Another block of proposals concerns the encouragement of e-commerce.</p>
<p>Today, both traders, retailers, and online traders are put on the same fiscal footing, although the rules of the game are different in all these segments. Experts propose creating conditions tailored to the specifics of business to support the development of e-commerce, which does not need certain elements such as cash-register machines or exhausting tax checks. Online traders could be exempted from providing proof of financial transactions, as the FISC can already track them electronically.</p>
<p><strong>So what did the Parliament vote on November the 11th?</strong></p>
<p>The first package to digitize the economy was voted in Parliament on the 11<sup>th</sup>&nbsp;of November 2021. After drafting the first version of the &#8220;Roadmap&#8221;, we prioritized tackling some of the problems alerted by the business community. A package of legislative changes has been drafted to allow:</p>
<p>&#8211; Remote registration of a company, modification of the incorporation or liquidation documents of a business;</p>
<p>&#8211; The possibility of using electronic signatures in employment relationships between employer and employee, including the signing of remote employment contracts;</p>
<p>&#8211; Unilateral recognition of qualified advanced electronic signatures issued in EU countries and the possibility to interact with Moldovan authorities remotely for European diaspora and investors;</p>
<p>&#8211; Possibility to obtain qualified advanced electronic signatures in Moldovan consulates abroad;</p>
<p>&#8211; Widespread use of electronic documents and consolidation for the benefit of the citizen of the provisions of the Law on electronic signature and electronic document;</p>
<p>&#8211; Introduction of electronic power of attorney in relations with public authorities;</p>
<p>&#8211; Obligation of public institutions, first of all, the Public Services Agency and the municipalities, to receive electronic documents and issue various documents (decisions, certificates, extracts, permits, etc.) in electronic format as a priority;</p>
<p>&#8211; Facilitate remote registration on the public procurement portal and subsequent e-procurement;</p>
<p>&#8211; The use of electronic documents in other areas of importance to business, including relations with public utility companies (gas, electricity, water/sewerage, communications, etc.);</p>
<p>&#8211; Eliminate notification and authorization as a personal data controller;</p>
<p>&#8211; Extend the binding forms of expression of consent of the citizen to the processing of personal data.</p>
<p><strong>I would not want us to miss out on the important details from this list. I suggest we dwell on some issues &#8211; how, for example, will remote registration of a company be carried out?</strong></p>
<p>At the moment, the legislative changes have yet to be published in the MO to enter into force, as the legislation contains several hurdles in the process of remote business registration. To make changes in the business incorporation documents, the entrepreneur has to physically go to the institutions. In the last two years, however, due to pandemic restrictions many entrepreneurs have been stranded abroad or quarantined, and not being able to make all the necessary changes remotely has severely limited their economic activity.</p>
<p>Parliament has passed changes to legislation that will allow entrepreneurs to open their businesses online. Moreover, the changes in the legislation will now also allow business people to make changes to their business incorporation documents online, and even to liquidate their business online.</p>
<p>Thus, the legislative changes will require the authorities to accept remote registration and liquidation of the business and to make changes in the incorporation documents using electronic signatures and electronic documents.</p>
<p>I also want to mention here that the authorities will now be obliged to issue documents in electronic format.</p>
<p><strong>So it will be possible to go paperless?</strong></p>
<p>Today, economic agents and individuals, although they have the right, according to the law on electronic signature and electronic document, not to physically come to state institutions to pick up or present documents requested on paper, this still takes place. As a solution, the draft law, voted by MEPs, foresees obliging public authorities to use electronic signatures and electronic documents in these processes, in parallel with the traditional method, for those who are not technologically ready.</p>
<p><strong>Will this also apply to employment contracts?</strong></p>
<p>The subject of digital contract signing arose during the pandemic period, when the relationship between employee and employer changed, with employers having to send their staff home and work with them remotely, etc.</p>
<p>All these changes in the employment relationship between employee and employer also imply changes in the employment contract. However, current legislation does not stipulate that contract changes can be made with an electronic signature. The employer is obliged to notify the employee under the signature of any change in the employment relationship, which is interpreted to mean that the employee must receive a document in duplicate which he must sign in holography, i.e. by hand. And this means that the man must physically come to work.</p>
<p>The document voted by MEPs gives economic agents and citizens the possibility to use electronic signatures in the establishment of employment relationships, if necessary, and to make it known by several methods that would confirm receipt of the information by the employee.</p>
<p><strong>You mentioned qualified advanced electronic signatures for EU countries. What does it mean?</strong></p>
<p>By voting on the first legislative package on digitization of the economy, the Republic of Moldova unilaterally recognizes EU e-signatures. Thus, after the entry into force of these changes, only EU-qualified advanced e-signatures will be acknowledged, which would allow existing investors to sign documents in Moldova and submit documents from EU countries that are no longer issued by the authorities on paper.</p>
<p>This will allow the enormous potential for attracting investment from the EU area to Moldova to be tapped and would reduce the constraints on foreign investors already operating in Moldova. Because Moldova does not accept electronic signatures from the EU, Moldova misses out on millions of euros of investment in one year alone, state authorities say.</p>
<p><strong>What other issues are important in the adopted document?</strong></p>
<p>Another important issue contained in the 1.0 package on digitization of the economy is that notification as a personal data controller will no longer be mandatory.</p>
<p>Such notification is required for any company processing personal data in an automated or manual system. This data refers to information about the consumer, employee, their salary, home address data, etc.</p>
<p>The spectrum of personal data is so broad that it is very difficult for Moldovan businesses to meet all the requirements of the National Centre for Personal Data Protection (CNPDCP) for obtaining the status of the personal data controller. Some entrepreneurs say that notification can take up to 7 months.</p>
<p>This has led to a situation where for 8 years, since the Law on Personal Data Protection has been in force, only about 3000 enterprises out of 240 thousand have passed the notification procedure as a personal data controller. I want to tell you that if the company operates with personal data and is not notified to the CNPDCP, it violates the law.</p>
<p>Another problem is also the fact that today the individual can only give written consent to the processing of his or her data with the application of a holographic signature or electronically with the application of a qualified advanced signature. This is a hindrance in the development of ICT solutions and remote interaction with the consumer. In the EU this problem has long been solved by diversifying the ways of expressing consent for processing personal data.</p>
<p><strong>What else do we need to be aware of? What are the next steps for digitization in 2022?</strong></p>
<p>The Council will continue focusing on identifying constraints for business and developing legislative measures to facilitate innovation in the Business-Government and Business-Consumer relationship. These two dimensions have a lot of room for modernization through digitization. In the immediate period ahead we focus on:</p>
<p>&#8211; digitization of certain aspects related to digital services in the notary;</p>
<p>&#8211; deepening remote interaction with tax authorities;</p>
<p>&#8211; removing barriers to e-Commerce from various outdated pieces of legislation and primarily from the customs code;</p>
<p>&#8211; stimulating e-payments and competition in this area to achieve more affordable services;</p>
<p>&#8211; developing the courier market and integrating e-Commerce elements into the postal sector throughout the country, etc.</p>
<p><strong>And this requires new channels and means of communication, doesn&#8217;t it?</strong></p>
<p>We have already created a platform for dialogue with businesses on issues of digitization of the economy under the aegis of the Vice Prime Minister for Digitization &#8211; iConsult, and we have also developed a mobile app for the business community &#8211; BizRadar.</p>
<p>These two tools will contribute through new methods of interaction and communication with business to the modernization of the Republic of Moldova.</p>
<p><strong>I have only one more request. Our interview inadvertently turned into a multi-page document, given the importance of the topic. Would you mind talking about these new means of communication, separately, in the near future?</strong></p>

<p>Gladly! We are interested in involving as many Moldovan entrepreneurs as possible in the process of constructive and effective dialogue, which would contribute to the implementation of these instruments in the country&#8217;s economic processes.</p>

										<content:encoded><![CDATA[<p>10 December 2021 &#8211; The legislative amendments on the digitisation of the economy, voted on 11 November 2021 by the Parliament, have been promulgated by Moldovan President Maia Sandu and published in the Official Gazette.</p>
<p>Thus, according to the new legal provisions, it becomes possible to remotely register businesses, changes in the acts of incorporation of legal entities, as well as other issues related to remote business administration. Until now this was impossible, even with the use of electronic signatures and documents.</p>
<p>Another provision concerns the mandatory issuance of permitting or confirmatory documents to business people remotely in electronic format.</p>
<p>The amendments also provide that personal data opperator (economic agents, organisations, state institutions) are no longer obliged to notify and register with the National Centre for Personal Data Protection.</p>
<p>Another set of legislative provisions in the enacted amendments concerns the use of qualified advanced electronic signatures in employment relationships.</p>
<p>One of the key legislative changes is the unilateral recognition by Moldova of qualified advanced electronic signatures issued in EU countries and the possibility for investors and the diaspora to interact remotely with Moldovan authorities.</p>
<p>The legislative initiative promulgated today also provides for other tools to digitise citizens&#8217; and businesses&#8217; interaction with the state, the first remote electronic methods, including the use of electronic power of attorney in relations with public authorities, remote registration on the public procurement portal and subsequent participation in e-procurement; the possibility of remotely finalising contracts with public utility companies, such as natural gas, electricity, water and sewerage, communications, etc.</p>
<p>The package of amendments for the digitisation of the economy was drafted by experts from the Economic Council to the Prime Minister of the Republic of Moldova. The document was promoted in Parliament at the initiative of the Chairman of the Committee on Economy, Budget and Finance, Dumitru Alaiba, with the full support of Deputy Prime Minister for Digitisation Iurie Țurcanu.</p>
<p>The legislative amendments on the digitisation of the economy were developed within the framework of the implementation of the Roadmap for boosting the process of digitisation of the national economy and development of e-commerce developed by the Ministry of Economy jointly with the Secretariat of the Economic Council to the Prime Minister of the Republic of Moldova, with international expertise provided through EBRD, USAID, GIZ, UK GGF and IFC.</p>

										<content:encoded><![CDATA[<p>11 November 2021 &#8211; Parliament adopted today in final reading the first legislative package for the digitisation of the economy. The document implements a number of key actions of the &#8220;Roadmap for boosting the digitisation of the national economy and the development of e-commerce&#8221;, prepared by the Economic Council to the Prime Minister, with the financial support of development partners (EBRD, IFC, USAID, GIZ, UK GGF).</p>
<p>This set of legislative amendments aims to achieve maximum impact in the short term, focusing on legislative interventions that will stimulate remote interaction between Government, Business and Consumer.</p>
<p>The law voted today aims to adjust 29 pieces of legislation to overcome existing constraints that limit the possibilities for remote interaction, promoting digital services and electronic identity for entrepreneurs and citizens.</p>
<p>Thus the voted document will allow remote registration of a company, modification of the documents of incorporation or liquidation of the business. The possibility of using electronic signatures in employment relations between employer and employee, including the signing of remote employment contracts. Unilateral recognition of qualified advanced electronic signatures issued in EU countries and the possibility to interact with Moldovan authorities at a distance for diaspora and European investors. Possibility to obtain qualified advanced electronic signatures in Moldovan consulates abroad.</p>
<p>The legislative changes also allow the wide use of electronic documents and the strengthening of the provisions of the Law on electronic signature and electronic document for the benefit of citizens. Introduction of electronic power of attorney in relations with public authorities. Obligation of public institutions, first of all the Public Services Agency and municipalities, to receive electronic documents and issue various documents (decisions, certificates, extracts, permits, etc.) in electronic format as a priority.</p>
<p>At the same time, today&#8217;s amendments will make it easier to register remotely on the public procurement portal and subsequently to carry out electronic public procurement. The use of electronic documents in other areas of importance to business, including relations with public utility companies (natural gas, electricity, water/sewerage, communications, etc.). Eliminate notification and authorisation as a personal data operator. Extending the legal forms of expression of the citizen&#8217;s consent to the processing of personal data.</p>
<p>The package of amendments for the digitisation of the economy was drafted by the team of experts of the Economic Council to Prime Minister Nicolae Botan, Roman Ivanov, Ilona Panurco and Sergiu Bozianu.</p>
<p>The adoption of this draft law provides an appropriate technological response to a series of constraints and challenges for citizens and businesses in the context of the pandemic crisis. This will ensure that the advantages of remote digital interaction can be exploited without delay, in line with best practices that have become the norm in most technologically advanced countries.</p>

Thus, the app becomes accessible to all members of the Economic Council and all entrepreneurs in Moldova, who can download and install it from Google Play and Apple Store.</p>
<p>The app has already been downloaded to mobile phones by several members of the Economic Council community, as well as by managers of Moldovan businesses.</p>
<p>BizRadar was developed at the initiative of the Economic Council Secretariat and is the first of its kind in Moldova. Through this software, members of the Economic Council and managers of private companies have the opportunity to keep abreast of the most important news on the regulatory framework in the economic field, participate in surveys on the state of affairs at the moment and challenges in different sectors of the national economy. Members of the BizRadar community can come up with proposals to overcome these problems, which will immediately reach the Government and the Prime Minister of the Republic of Moldova, this source being a short and efficient way of interaction to contribute and improve the decisions of the authorities on various topics related to the development of a favourable business environment.</p>
<p>BizRadar also offers the possibility to give appreciation to business interaction with state institutions. Based on the provided estimates, an overall score of the institutions will be formed to measure the performance of their activity and motivate the state authorities to continuously improve their services, thus contributing to the development of the business climate in the country.</p>
<p>Through the App, entrepreneurs can also, without revealing their identity, report abuses of power by state institutions.</p>
<p>All the information in the application will be processed by the Secretariat of the Economic Council, which will analyse it and bring it to the attention of the institutions, which have difficulties in communicating with the business community. These developments will be kept under constant review by the Prime Minister and the Government.</p>
