ECONOMIC COUNCIL TO THE PRIME MINISTER OF THE RM
Experts of the Secretariat of the Economic Council to the Prime Minister convened the first meeting of the Working Group No. 8 on the reform of air, sea and road transport control systems. The meeting was attended by representatives of the State Chancellery, the Ministry of Infrastructure and Regional Development, the National Motor Transport Agency, the Naval Agency, the Civil Aviation Authority, the business community and other stakeholders.
The participants are to review the regulatory framework with a view to improving the situation, as provided for by Government Order 108-d of 25 July 2023. According to the participants of the meeting, the Road Transport Code contains provisions according to which the LPAs shall periodically monitor the provision of road transport services against payment of passengers in local, municipal and district traffic, according to their competence, and in case of violations, refer the matter to ANTA for withdrawal of authorizations.
On the other hand, ANTA’s duties include a) applying contravention penalties, within the limits of its competences, in accordance with the provisions of the law; b) monitoring the correct application of tariffs for regular road transport services in national traffic and in the activity of bus and coach undertakings. It is therefore recommended to review ANTA’s control areas. In the shipping sector, it is noted that a large proportion of the checks carried out on operators in port or on ships involve inspection and verification of safety aspects in the workplace. Requirements in this respect are set out in the checklists applied by the Maritime Agency. In this respect it is obvious that part of the security risks of the whole controlled object are similar or tangential to occupational safety risks.
This shows potential overlap and duplication with the control actions of the State Labour Inspectorate. And in the air chapter, among other things, it is noted that, according to the Air Code and GD no.133/2019 the Civil Aviation Authority (CAA) has the task of controlling the correctness of the formation of charges for airport and air navigation services which sounds like a new area of control that is not included in national legislation. It is recommended to review the appropriateness of the control functions (correctness of charging for airport and air navigation services) for the CAA. Respective amendments to the regulatory framework should be made accordingly.
These and other problems have largely been identified by business associations and experts. Proposals to address them are largely based on practices and principles promoted by the Organisation for Economic Co-operation and Development, including mechanisms and principles on state control of entrepreneurial activity that currently exist in Moldova. The reform of the system of state control over entrepreneurial activity is planned for 2023-2024 and is being promoted with the support of the business community, members of the Economic Council, representatives of state institutions and donor organisations, including the USIAD/MISRA project.
